DISCLOSURE

Alabama law requires you, the consumer, to be informed about the types of services which real estate licensees may perform. The purpose of this disclosure is to give you a summary of these services.

Alabama Real Estate Agency Disclosure (RECAD)
Rule 790-X-3-.13(1)
Real Estate Brokerage Services Disclosure

  1. A SINGLE AGENT is a licensee who represents only one party in a sale. That is, a single agent represents his or her client. The client may be either the seller or the buyer. A single agent must be completely loyal and faithful to the client.
  2. A SUB-AGENT is another agent/licensee who also represents only one party in a sale. A sub-agent helps the agent represent the same client. The client may be either the seller or the buyer. A sub-agent must be completely faithful to the client.
  3. A LIMITED CONSENSUAL DUAL AGENT is a licensee for both the buyer and the seller. This may only be done with the written, informed consent of all parties. This type of agent must also be loyal and faithful to the client, except where the duties owed to the clients conflict with one another.
  4. A TRANSACTION BROKER assists one or more parties, who are customers, in a sale. A transaction broker is not an agent and does not perform the same services as an agent.
  • Alabama law imposes the following obligations on all real estate licensees to all parties, no matter what their relationship.

    • To provide services honestly and in good faith;
    • To exercise reasonable care and skill;
    • To keep confidential any information gained in confidence, unless disclosure is required by law or duty to a client, the information becomes public knowledge or disclosure is authorized in writing.
    • Present all offers promptly to the seller; Answer your questions completely and accurately

    Further, even if you are working with a licensee who is not your agent, there are many things that the licensee may do to assist you. Some examples are:

    1. Provide information about the properties;
    2. Show properties;
    3. Assist in making a written offer
    4. Provide information on financing
  • Why should you choose a Certified Residential Specialist?

    1. A Mix of Experience and Sales
    A hallmark of Certified Residential Specialists isn't just the advanced training and education they receive. Just as important is the marketplace expertise they bring to the sale or purchase of your home. To earn the Certified Residential Specialist Designation, every REALTOR® must have a significant mix of experience and number of real estate transactions. These strict requirements are your assurance that your Certified Residential Specialist is able to apply his or her education in the real world, giving you the knowledgeable, skilled service you expect.

    2. Highest Standard of Ethics
    Ethics aren't just important in a REALTOR®. They're essential. That's why every Certified Residential Specialist is required to maintain membership in the NATIONAL ASSOCIATION OF REALTORS® and to abide by its strict Code of Ethics. That means, when you work with a Certified Residential Specialist, you can rest assured you're dealing with a trained real estate expert who will treat you fairly and professionally every step of the way.

    3. A Focus on Home Buying and Selling
    Whether you're looking to by or sell a home, you face many risks along the way. Financial risks, legal risks, even the risk that a home purchase or sale will fall through. A Certified Residential Specialist is trained to minimize those risks. With that in mind, a Certified Residential Specialist is guaranteed to bring you the benefits of their significant experience and variety of successful real estate transactions. That expertise, combined with advanced education in areas like finance, technology and marketing, lets you know that your Certified Residential Specialist is able to make your home purchase or sale a success in every way.

    4. Technological Expertise
    Technology is changing the face of real estate. Computers, the Internet, mobile communications - each has helped make the market more efficient, and at the same time more daunting. More than ever, the success of your home purchase or sale depends on the ability of your REALTOR® to harness that technology, and make it work for you. For that reason, the training required of your Certified Residential Specialist focuses extensively on technology and its effect on the real estate business. You can count on a Certified Residential Specialist not just to understand technology, but to use it to make your home purchase or sale a worry-free experience.

    5. An Ability to Maximize the Profits & Minimize Costs
    Buying a home isn't simply about paying the lowest price. And selling a home isn't just about getting the money you asked for. Along the way, there are fees, taxes and numerous other costs that can impact the bottom line of your home purchase or sale. A Certified Residential Specialist is trained specifically to help you understand the marketplace, negotiate successfully on your behalf and get a clear picture of a proposed transaction. The result is a more rewarding experience, whether you're buying or selling, or both.

    What is an e-PRO and why should you use one?

    A short guide for the Internet consumer

    When you're on the Internet, you don't have time to waste on endless searches for useful real estate information. You want to get things done quickly and without hassle. So chances are you'd like a real estate agent who

    • Answers e-mail promptly and professionally.
    • Respects your on-line privacy.
    • Offers home listings and other Internet tools to help you find or market a home.

    Enter the e-PRO.

    An e-PRO is a REALTOR® who has successfully completed the e-PRO training program for real estate professionals. Endorsed by the National Association of REALTORS®, the e-PRO course teaches professionals the nuts and bolts of working with real estate on-line: Web sites, e-mail, on-line tools, and most of all, what today's consumer really wants.

    What does all this mean to you? There are several benefits of working with a certified Internet professional.

    More privacy

    Are you reluctant to give out contact information through the Web for fear of being pestered or spammed? e-PROs understand. They've learned the Web isn't just a place to do business; you need information from someone you can trust.

    That's why e-PROs respect your privacy. They respond quickly to your questions, but don't send you unwanted communication. And they protect your personal information.

    Less hassle

    Tired of struggling to find information? e-PROs are more likely to have access to the latest Internet utilities, making your life easier. These tools may include:

    • On-line home tours
    • Instant access to comprehensive neighborhood data
    • Extensive property listings
    • Immediate e-mail notification of just-listed homes meeting your criteria
    • Referral networks and on-line forums, where e-PROs can quickly find information--even potential buyers--from other e-PROs
    • Newsletters on current real estate conditions in your area
    • Electronic faxes sent to you by e-mail
    • Advanced software, PDAs, and laptops to find you answers on the spot

    The result: you get more information, more easily. With electronic files, you have less paperwork to deal with. And since your agent uses e-mail, you can even eliminate phone tag. The e-PRO streamlines your entire transaction, from showing to closing.

    Less expense

    An e-PRO's access to advanced technology can save you considerable expense. You have more tools to find or market your home, so you're likely to get a better price. With on-line home tours, you reduce in-person showings--and the costs involved. And by using e-mail, you save money on long-distance calls and fax charges.

    Relocating? An e-PRO is ideal for you. With the tools to do your research electronically, you can make a decision on a home the first day you're in town--or without traveling at all. You and your family save on travel costs. And after you've decided to buy, monitoring the sale by e-mail saves you even more.

    Real Estate Contracts >Understanding The Contract

    When you are selling a home, the most important part of the transaction occurs after you have found a buyer. If your property is being marketed professionally, the real estate agent will put together the purchase offer and present it to you.

    Each local Board of Realtors has standard contract forms which reflect the legal requirements of the jurisdiction in which you live. These contracts include the sales price, financing contingencies, completion deadlines, and other items that are required in order to meet local government requirements.

    You may find that trying to sell your own home in order to save the brokerage fee is false economy. Real estate sales are complicated, and a slight variation in language can sometimes cost you a sale and/or a lot of money. Many of our listings came from sellers who thought their homes were sold, only to lose the buyers at the last minute--on a technicality!
